Yes. Georgia's Open Record Act grants the general public access to most records generated by public agencies, including court records, provided they are not otherwise exempted by law or a court order. Hence, besides certain exempt court records, anyone can access most court records in Truop County by querying the custodians of these records. In Troup County, a civil case can fall under the jurisdiction of the Superior, State, or Magistrate Court. Troup County Superior Court has broad civil jurisdiction, and the State Court can try civil matters (regardless of the amount claimed) that the Superior Court does not exclusively handle. Meanwhile, the Magistrate Court can handle civil claims involving $15,000 or less.

Therefore, interested persons can query the Clerk's Office of the specific courthouse that handled the civil case to get Troup County civil court records. Each Clerk's procedures for requesting or accessing civil court records they maintain may differ. Nonetheless, record seekers should be able to provide specific information about the civil case whose court record they wish to get, such as a case number or party name. On the other hand, interested persons can get court records of civil cases heard by the Troup County Magistrate Court by contacting the court's civil jurisdiction. Alternatively, interested persons can visit the magistrate courthouse and query the court's staff to get court records of relevant civil cases.

Troup County Marriage Records

Troup County Probate Court is responsible for issuing marriage licenses and maintaining marriage records. Therefore, interested persons can obtain Troup County marriage records through the county probate court.

Unfortunately, the County Probate Court's webpage provides little information on requesting marriage records. Hence, record seekers can contact the Probate Court Clerk to inquire about the court procedures for requesting marriage records. On the Probate Court staff page, interested parties can find the contact information for the County Probate Court staff, including the probate judge, deputy chief clerk, and court clerks. Meanwhile, records seekers can also visit the probate courthouse to make requests for marriage records in person.

It is worth noting that Troup County marriage certificates and applications are also available through the Georgia Department of Public Health (DPH). However, this is limited to marriages that occurred between June 1952 to August 1996. Furthermore, the DPH only issues certified copies of marriage certificates to qualified persons (i.e. the Bride and Groom). Eligible persons can use the DPH's Request for Search of Marriage Form to make their request. The DPH also verifies marriages that occurred on or after January 1, 2014, throughout Georgia and its counties, including Troup County. Interested persons can utilize the DPH's Marriage Verification Request Form to request for marriage verification. DPH charges a $10.00 non-refundable search fee for marriage certificates or verification requests. The fee covers one certified certificate or verification letter; additional copies cost $5 each.

Troup County Divorce Records

In Troup County, divorce proceedings are heard by the County Superior Court. As previously mentioned, Troup County's Clerk of Court is responsible for the clerical duties of the County Superior Court. Hence, the County Clerk maintains divorce and other court records generated by the Superior Court.

Therefore, interested persons can find Troup County divorce records by querying the County Clerk of Court office. Record seekers may search divorce records online through the County Clerk of Court's Case Search portal. On the portal, users should select "civil search" and then select "domestic". Additionally, searches can be conducted by case number, party name, CSE number, or date filled. For divorce records that are unavailable online, record seekers can visit Troup County's Clerk of Court office or the Superior Courthouse to request records in person. Note that in-person requests may be subject to certain fees.

Troup County Birth and Death Records

Troup County vital records, including birth and death records, are accessible through the DPH's State Office of Vital Records and Troup County Health Department. The State Office of Vital Records maintains birth and death records from January 1919 to the present, while the Troup County Health Department maintains older records.

Per OCGA § 31-10-26, vital records are only issuable to eligible persons with a direct and tangible interest in the records. These eligible persons include:

  • The person named on the record (for birth records)
  • The registrant's parent, grandparent, or legal guardian
  • The registrant's adult child or sibling
  • The registrant's spouse or next of kin
  • The registrant or their immediate family member's attorney
  • An authorized representative of Federal, State, or County agencies of government that require the record in conducting their official duties.

Troup County Health Department and the DPH's State Office of Vital Records accept in-person and by-mail requests for vital records. Eligible requesters must provide proper identification when requesting Troup County birth or death records from either agency. Furthermore, requests are subject to certain fees. The DPH's State Office of Vital Records charges requesters $20 for a certified copy of a birth or death certificate, and additional copies cost $5.

During regular work hours (Monday to Friday, usually between 8 a.m. to 4 p.m.), walk-in requests can be made by visiting the Troup County Health Department or the DPH's State Office of Vital Records physical location.
