What Kinds of cases have been heard in Gwinnett Superior Court?

As a trial court, the Gwinnett County Superior Court can render verdicts in jury trials and provide legal remedies for a wide range of civil disputes. These include real estate claims, equity cases, declaratory judgments, adoptions, prohibition, divorce, and felonies prosecuted by the District Attorney’s Office. In addition, the court has the authority to handle appeals from lower courts and may issue writs of certiorari to correct judicial errors when appropriate.

Gwinnett County Superior Court

The Gwinnett County Superior Court is composed of ten judges. Cases filed with the court clerk are bound to be heard and decided by one of these judges. For family law matters, however, the same judge typically retains jurisdiction over cases involving the same parties. It is important to note that every judge has their own team, including staff attorneys and calendar coordinators.

These individuals can assist with inquiries; they may be able to answer questions on the criteria required to have a case heard and decided by a specific judge. Hearings are generally scheduled within 60 days of request.

Unlike Superior Courts in other Georgia counties, Gwinnett County Superior Court does not have a separate family division; its ten judges decide all cases, including family law matters.

Gwinnett County Case Lookup

In Gwinnett County, the Superior Court Clerk—the primary custodian of Superior Court records—doubles as the record custodian and clerk of the magistrate, state, and juvenile courts. Consequently, individuals wishing to access Gwinnett County's official court records can apply to the Clerk’s office. A county-wide search for records of the Superior Court’s cases can also be conducted online through the Odyssey case management system on the GwinnettCourts.com website. The Courts IT Division designed and managed the system. Users are required to follow this procedure to facilitate a search on the website:

  • Visit the County Clerk’s website
  • Select Gwinnett Courts Portal on the left-hand side of the page;
  • If you are a first-time user, select "Register" at the top, right-hand corner of the portal home page and fill out the registration form with the appropriate details before signing in;
  • Otherwise, just select "Sign in" and enter the registered username and correct password;
  • Once signed in, select "smart search";
  • Specify the relevant court record in the search bar by entering the record number or the full name;
  • Finally, click the submit button to facilitate a search.

The GSCCCA program is a state-wide initiative devised by the Georgia Superior Court Clerks' Cooperative Authority. The program seeks to provide access to digital versions of certified documents from court systems across Georgia. The authority’s eCertification portal enables researchers to look up and electronically purchase copies of records maintained by participating courts. For Gwinnett County, the participating courts are the Magistrate Court and the Superior Court. Consequently, new users can look up court records by following these steps:

  • Visit the eCertification portal
  • Select "Click here" to check if the court whose record you seek is a participating court.
  • Upon this confirmation, proceed to create an account;
  • Log in and click on the "Submit a New Request button" at the top right-hand corner of the home page

Gwinnett Superior Court Docket Search

Gwinnett Superior Court docket refers to a log of all activities in a case or proceeding that the Superior Court is handling. As new events arise, court dockets are chronologically updated to reflect recent developments until the case is finally concluded. The series of developments that may arise include:

  • Filings (e.g., complaints, motions, responses).
  • Scheduled hearings and court dates.
  • Orders, rulings, and judgments issued by the judge.
  • Notices and other communications.

Supreme Court vs. Superior Court

As a trial court, the Gwinnett County Superior Court has jurisdiction to preside over a wide range of criminal and civil disputes. Similar to the Supreme Court, the Gwinnett Superior Court handles appeals from lower-level courts. However, its decisions on those cases are not considered to be final; dissatisfied parties are free to appeal to the Georgia Court of Appeals. While there are several Superior Courts across various counties in Georgia, there is only one Supreme Court in the state of Georgia.

The Supreme Court of Georgia is the highest appellate court in the state. This means that the Supreme Court can reverse verdicts rendered and judgments given by judges of the Gwinnett County Superior Court. This is possible even if the decision got unanimous approval from the Georgia Court of Appeals. Judgments given by the Supreme Court are final. In addition to its appellate jurisdiction, the Supreme Court of Georgia also presides over contentious constitutional and legislative issues bordering on interpretation. However, its jurisdiction is limited only to state matters. It cannot preside over federal law matters. Federal law cases can properly be decided on by the US Supreme Court and other Federal courts.
