Carroll County Arrest Records Vs. Criminal Records

Arrest records, sometimes called ‘arrest logs’, are records of the arrest history of an individual. An arrest record details the list of offenses for which an individual was arrested. Unlike criminal records, arrest records do not contain information on the final outcome of a case. Also, an arrest record cannot be used to prove that a person broke the law, instead it only shows that the person was a suspect at a point in time.

Both types of records are considered public and can be requested by a member of the public at any time, barring situations where the records have been sealed, expunged, or contain information about a juvenile person.

How Long Do Arrests Stay on Your Record?

According to Georgia law, a person who has been arrested but has yet to be charged with a crime will have their record restricted after:

  • Two years in the case of a misdemeanor
  • Four years for most felonies
  • Seven years for violent or sex-related felonies

That said, if the person is charged, the arrest will remain on their record indefinitely. This can only be amended by sealing or expunging the record.

Expunge Carroll County Arrest Records

Sealing or expunging an arrest record in Georgia state is referred to as record restriction. It is not called expungement because the records are not destroyed.

Individuals who successfully restrict their arrest record can apply for licenses or jobs and can rent or purchase property without their arrest record showing up in a background check. However, the arrest will still be accessible to courts and law enforcement agencies.

Not everyone is eligible for a record restriction. Arrests that do not lead to convictions and certain misdemeanors are eligible for record restriction. Also, cases that remain on the dead docket for over 12 months are eligible for record restriction.

The process involved in record restriction has been altered due to changes in Georgia law. If your arrest record was issued before July 1, 2013, the record restriction request will have to be processed by the arresting agency. However, if your arrest was issued after July 1, 2013, you should contact the prosecuting attorney’s office directly.

Once your record restriction request has been approved, it must then be submitted to the Georgia Bureau of Investigation’s Georgia Crime Information Center (GCIC). After this, the arrest record will no longer be accessible to the general public.

Carroll County Arrest Warrants

An arrest warrant is a written order issued to a police officer that authorizes them to take the person named in the warrant into custody so they can be dealt with in accordance with the law.

An arrest warrant specifies the name of the person who has been accused of an offense. It includes the offense the suspect has been accused of committing and the signature of the magistrate who ordered the arrest.

Do Carroll County Arrest Warrants Expire?

Arrest warrants in Carroll County do not expire. Rather, once an arrest warrant fails to lead to the arrest of the accused person, or if the arrested person receives bail and fails to show up, it leads to the issuing of a bench warrant.

In other words, arrest warrants are active indefinitely, and if the suspect is arrested and tries to avoid following through by appearing in court, the bench warrant ensures that the purpose for which the arrest warrant was issued is completed.

Since arrest warrants remain active indefinitely, they cannot be avoided. The only way around an arrest warrant would be to appear before the court and prove beyond doubt that the warrant is deficient. Either way, it is advisable to contact an attorney before attempting to fight a warrant.
